Legal Counsel - BMW Financial Services & Alphabet GB Ltd

To act as a Legal Advisor to provide advice to BMW Group Companies in the UK, in particular the companies within the BMW Financial Services Group and Alphabet, on all relevant legal issues

Key Accountabilities

Assisting with a BMW Group-wide data protection project, including negotiating contract variations with data processors;

Taking detailed instructions from representatives of the businesses within the BMW Financial Services Group and Alphabet and providing advice on commercial matters;

Assisting with the completion of tender responses for Alphabet;

Handling simple litigated matters and prosecutions;

Drafting and negotiating contracts with insurers and brokers and assisting with Alphabet’s application to the FCA for insurance mediation permissions;

Negotiating contract drafting and negotiation of commercial contracts including contracts relating to vehicle leasing and the provision of vehicle related services with customers and contracts with suppliers to reflect the commercial aims of the business while ensuring legal compliance and risk management;

Advising management and staff and ensuring compliance with and awareness of legal issues and developments arising out of new legislation, rules, regulations, guidance, case law and industry codes of practice pertaining to the finance industry and in particular the automotive finance industry;
Participating in cross functional teams relating to various areas of the business including new 

product development and regulatory changes;

and
Providing advice in relating to IT matters and drafting supplier agreements.Qualifications & Skills

Qualified solicitor or barrister with seven years plus experience of consumer and non consumer credit and hiring, preferably within an in-house setting, with extensive and detailed knowledge of the following areas of the law:


current and future regulation of consumer credit and hiring in the UK;

consumer law including distance selling and marketing;

unregulated credit and hiring, including the provision of wholesale finance facilities and equipment leasing;

insurance mediation;

data protection;

IT law;

company law;

insolvency;

litigation;

agency;

and general contract law.The applicant must have excellent contract negotiating and drafting skills, and be able to handle a heavy, varied and challenging workload. They must demonstrate strong interpersonal skills and a good understanding of the commercial, legal and regulatory environment to enable them to work independently and as part of cross-functional teams. The applicant must be self-motivated to increase their knowledge of the relevant areas of the law as they develop and also have good IT skills.
